Contract terms and conditions This agreement is between Samantha Jane Photography and hereby referred to as (The Client). 1. This agreement contains the entire understanding between Samantha Jane Photography and the Client. It supersedes all prior and simultaneous agreements between the parties. Only those changes or modifications specifically placed in writing, attached, dated and signed by the Clients and Samantha Jane Photography at the time of acceptance of this contract shall be recognised as amendments to this contract. 2. Upon receipt of the booking fee, Samantha Jane Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the booking fee of £300 is non-refundable, even if the date is changed or the wedding cancelled for any reason; including acts of God, fire, strike and/or extreme weather. The booking fee is to be paid at time of signing the contract. The booking fee is applied towards the contracted wedding photography package. 3. In the event that the Client cancels the contracted services for wedding photography outlined in this contract before the wedding ceremony takes place, the deposit will be forfeit. Samantha Jane Photography agrees to refund all additional paid money (less expenditures for which receipts will be provided), to the client. Cancellation within three months of the date of the wedding will result in 50% of the final balance being due. Cancellation of the wedding within one month will result in the full balance being due. 4. The Client understands and agrees that the entire amount owed for the wedding photography package is due four weeks before the date of the wedding. 5. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Samantha Jane Photography will make every effort to secure a replacement photographer of the same professional standing and ability able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received. 6. Samantha Jane Photography takes the utmost care with respect to exposure, transportation and processing of photographs. However, in the unlikely event of the Client’s photographs being lost, stolen or destroyed for reasons beyond Samantha Jane Photography's control, the latter’s liability is limited to the return of all payments received for the event package. 7. Samantha Jane Photography will document the events in a candid manner and take formal portraits as necessary. Prior to or during the event, the Client may inform the photographer of subjects which they would like photographed, but the final content of the images is at the discretion of the Photographer. Although every possible care will be taken to produce photographs of all important and special events during the wedding, Samantha Jane Photography cannot place an unconditional guarantee on the above. The Couple also agree to give the photographer sufficient warning of key events at the wedding to give the photographer time to prepare, e.g., bouquet throwing, cake cutting, speeches etc. Special requests are not binding instructions, although every effort is made to comply with the clients wishes. We shall be entitled to assume unless you inform us otherwise prior to the Event that all persons attending the Event have consented to being recorded. Please note that not all guests at a wedding like having their photo taken, in such cases the photographer will use his/her discretion but cannot be held responsible for a lack of photos of these people. 8. The entire copyright in the photographs is retained by the photographer at all times throughout the world. The client must seek permission for use beyond reproduction and printing for friends, guests and family. The 1998 Copyright, Designs, and Patents Act assigns copyright to Samantha Jane Photography. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing. LICENSE The photographer shall be granted complete artistic license including in relation to the poses photographed and the locations used. The photographer’s judgment regarding the location/poses, number of images taken and album design shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. 9. The Clients hereby allow the photographer to display any images covered by this contract and to generally promote the business by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles, and other such media, providing that the images are used lawfully and without damage to the clients. No use of the images will be made by the photographer/s for other commercial reason except with the written permission of the client. 10. The client understands that no unedited images will be released. 11. The photographer is limited by the guidelines of the ceremony official or the reception site management. The Client agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is The Client’s responsibility; Samantha Jane Photography will offer technical recommendations only. Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the Photographers shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. 12. Samantha Jane Photography will be the only paid professional photographer (stills) on the day of the wedding at the venues specified. Samantha Jane Photography does however positively encourage family, friends, and other guests to take photographs throughout the day. Samantha Jane Photography reserves the right to ask other people to refrain from taking photographs at key times, if it is considered that this may compromise the quality of the photographs. 13. Samantha Jane Photography will not tolerate any level of verbal abuse or aggression. Either will result in the immediate suspension of coverage. 14. If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect. 15. The client may cancel this contract within 14 days of the receipt of the deposit or accepting quote without giving any reason by giving written notice to the photographer. If the right to cancel is exercised within 14 days then any monies paid to the photographer will be reimbursed. The photographer reserves the right to make a deduction from the reimbursement for loss in any value of any goods or services supplied. The reimbursement will be made without undue delay. 16. Any complaints must be raised by the client with the photographer in writing with 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of images 17. The client understands that the turnaround of the completed images will be done in a timely fashion. This will usually be no more than 6-8 weeks after the date of the wedding. 18.Wedding Albums As wedding albums are bespoke, handmade products that are individually commissioned for each couple are exempt from the regular ‘returns’ part of the ‘Consumer Rights act 2015’, with that in mind it’s important to take the time to fully check design and cover proofs that will be emailed to you. Once you have approved the proofs, your album will be sent for print and any further enquiries will be a matter for the printing company (turn around time once sent to print is usually 7-14 working days). Please note that should requests for Album selections not be provided within three months of being offered the assignment shall be considered complete. This agreement shall be governed in accordance with the laws of England & Wales By signing digitally you are agreeing that you have read and understood the terms above and hereby agree to the terms of this agreement.
